1. Eligibility & Enrollment
- You must be at least 18 years old and have a Brivio account in good standing.
- Enrollment uses a hybrid approval model: applications may be auto-approved based on account standing or manually reviewed by our team. We may decline any application at our discretion.
- Affiliates must provide accurate identification and, where payouts in cash are requested, valid billing details.
- One affiliate account per person or legal entity. Sub-affiliate networks, multi-level structures or commission pyramids are not permitted — this is not an MLM program.
2. Commissions & Tiers
Affiliates earn a recurring commission of 20% of the net subscription revenue (excluding VAT, discounts and refunds) generated by each referred customer, for the first 12 months of that customer's paid subscription.
- Bronze tier: 20% recurring commission (default).
- Silver tier: 25% recurring commission, granted based on performance criteria published in the affiliate portal.
- Gold tier: 30% recurring commission, granted based on performance criteria published in the affiliate portal.
- Tier upgrades apply to commissions accrued after the upgrade date; they are not retroactive.
- We may adjust tier criteria prospectively with notice via the affiliate portal.
3. Attribution & Tracking
- Referrals are tracked via your unique affiliate link using a 30-day cookie.
- Attribution is last-click: the most recent affiliate cookie at signup wins.
- If the cookie is deleted, blocked, or expired before signup, no attribution occurs. We are not liable for missed attribution caused by browser settings or third-party software.
- Self-referral (using your own link for accounts you own or control) is prohibited and voids the commission.
4. Payouts
- Commissions are held for 30 days after accrual (hold period) to cover refunds and chargebacks.
- Payouts are credit-first: approved commissions are issued as Brivio account credit by default.
- Cash payout may be requested once your approved balance reaches at least 250 RON.
- Cash payouts to Romanian companies require a valid invoice and, where applicable, an e-Factura submitted via the ANAF system. Individuals must comply with applicable income declaration rules.
- If a referred customer receives a refund or a payment is reversed, the corresponding commission is reversed. Negative balances are offset against future commissions.
5. Prohibited Conduct
- Self-referral or referring entities you own or control.
- Unsolicited bulk messaging (spam) by email, SMS, or social media.
- Bidding on Brivio brand keywords (or misspellings) in paid search (PPC brand bidding).
- Cookie stuffing, forced clicks, iframes, or any technique that sets the affiliate cookie without a genuine user click.
- Misleading claims about Brivio's features, pricing, or affiliation — including presenting yourself as Brivio or an official Brivio partner without authorization.
- Operating or promoting sub-affiliate/MLM-style recruitment structures.
- Any unlawful promotion or promotion on sites with illegal or hateful content.
6. Fraud & Consequences
We monitor Program activity for fraud and abuse. Where we determine, acting reasonably, that these terms were breached, we may: (a) forfeit unpaid commissions related to the breach; (b) suspend or terminate your Program participation; and (c) in serious cases, suspend the associated Brivio account. Fraudulent self-referral or tracking manipulation always results in forfeiture of the affected commissions.
7. Taxes
You are solely responsible for declaring and paying any taxes, contributions, or social charges due on your affiliate earnings under the law applicable to you. Brivio may withhold amounts where required by law and may request tax identification information before releasing cash payouts.
8. Data Protection
We process affiliate personal data (identification, contact, payout and performance data) as a controller, in accordance with our Privacy Policy and the GDPR. Referral statistics shown to affiliates are aggregated; affiliates do not receive personal data of referred customers.
9. Termination & Changes
- You may leave the Program at any time from the affiliate portal; approved commissions accrued before departure remain payable subject to the hold period.
- We may terminate participation with 30 days' notice without cause, or immediately for breach of these terms.
- We may amend these terms; material changes take effect 15 days after notice via the affiliate portal or email. Continued participation constitutes acceptance.
10. Governing Law
These terms are governed by Romanian law. Disputes are subject to the competent courts of Gorj county, Romania — the seat of the operator — without prejudice to mandatory consumer protection rules that may apply to you.
